44-5-26 states: Appeals to the local tax board of review are to be filed not more than thirty (30) days after the assessor renders a decision and notifies the taxpayer.

How do you notify the taxpayer of your decision? USPS, Registered Mail? I have been mailing notice, regular USPS allowing 2 days plus the 30 for BOR filing deadline. I have a taxpayer that I sent notice to over 45 days ago but claims he just received. How would you handle?

    CHARLESTOWN –

I handle the mailing the same way you do. I have never denied an appeal based on late filing.

My Tax Board of Review wants the opportunity to decide if the appeal had merit, regardless of late filing.
